Foreclosure

By: Paul Staley

Don't ignore the problem.

The worst thing that you can do when you are falling behind in your house payments is to ignore the problem. It is natural to want to hide your head in the sand, and understandable but this isn't the time.

You need to know your options. That means you need to talk to people. This will include the holder of your mortgage and possibly bankruptcy attorney. This will be so you can get enough information to make a good decision for yourself and your family. Some of the following suggestions could each be wise or unwise depending on your particular situation. Get advice. Don't act in an information vacuum.

Read and find all your paperwork and documents about and that concern to your mortgage. You might need help understanding what it all means. Be sure to ask questions. Call your lender if need be and ask to speak to someone who knows. These days they will have people who can talk to you. The lender doesn't want your house back.

Open all your mail from your lender: The first notices will tell you about foreclosures and what to do next; the last letters will let you know about legal action. Not knowing isn't an excuse in court.

Prioritize spending: Do you really need the cable, the cell phones; the eating out. The first priority after healthcare should be your house.

Use your assets. It might be time to sell jewelry or the second car. There might be a second job or someone in the household that can go to work.

Avoid "stop foreclosure" companies: They will charge fees for what your lender will do and tell you for free. Just keep in mind that the lender doesn't want your house.

Don't lose your house to foreclosure scams:
If a company says he can stop a foreclosure, don't sign anything without a lawyer. They might be just taking your house without a meaningful gurantee of accomplishing anything for you. Get an attorney's advice.
